Purpose

This policy outlines when and how a former registrant may be eligible for reinstatement of a registration under the Travel Industry Act, 2002.  This policy also clarifies the distinction between Late Renewals and Reinstatements, recognizing that both occur after registration expires but are treated differently within TICO’s registration framework.

Late Renewal (Grace Period)

A registration that has expired may still be renewed during a grace period extending from the 1st day of the month up to and including the 17th day of the month in which the registration expired.

  • Renewals completed during this period are considered Late Renewals.
  • Late Renewals are part of the Renewal Process.
  • Late Renewal fees apply.
  • Although the registration has technically expired, Late Renewals are processed as renewals, not as new applications.
  • Any extension to the last day of the grace period must be documented and approved by the Manager, Registration Services and/or the Registrar.

Registrants who fail to renew within this grace period are no longer eligible for Late Renewal and must be assessed under the applicable reinstatement or application rules set out below.

Eligibility for Reinstatement

Reinstatement is a discretionary process available only in limited circumstances, subject to regulatory compliance and Registrar approval.

Registrations Not Eligible for Reinstatement

Reinstatement is not available in the following circumstances:

  1. Revoked registrations
    A new application for registration is required.
  1. Expired registrations beyond the Late Renewal grace period
    A new application for registration is required.

Voluntarily Terminated Registrations

A registrant who voluntarily terminated their registration may be eligible for reinstatement, subject to the following guiding criteria:

  1. The voluntary termination occurred within the last 365 days.
  2. There is no indication of continued operation after the termination date.
  3. There are no unresolved compliance issues, complaints, or claims against the Compensation Fund.
  4. All fees and financial filing requirements due up to the date of termination have been paid and are up to date.
  5. The former registration was not terminated in connection with legal proceedings (if so, additional consideration is required).
  6. Neither the former registrant nor any former Key Business Personnel has been associated with conduct demonstrating a lack of honesty or integrity detrimental to the travelling public, in the opinion of the Registrar.
  7. There have been no material changes to the business structure or Key Business Personnel that would negatively impact eligibility for registration.
  8. Where applicable, any required Criminal Record Check and/or Credit Check would not reveal information impacting eligibility for registration.

Reinstatement Approval

Where the Registrar determines that all eligibility criteria have been satisfied:

  1. The registrant may be reinstated without submitting a new application for registration.
  2. A new application fee will not be required.
  3. A security deposit will not be required, provided the former registrant previously filed two consecutive annual financial or verification statements, and the Registrar has no outstanding compliance concerns.
  4. All reasonable efforts will be made to re‑issue the same registration number, where administratively feasible.

Registrar’s Discretion

Reinstatement is not automatic. All requests are assessed on a case‑by‑case basis, and the Registrar may refuse reinstatement where it is not in the public interest or where legislative requirements have not been met.
