Sinorama Holidays Inc. in Markham, Ontario voluntarily terminated its Ontario Travel Industry Act, 2002 registration to do business as a travel retailer and travel wholesaler effective August 08, 2018.

The following is a guide to assist consumers and travel agents with future bookings. Please read the Advisory in its entirety to ensure that you have been fully informed. This Advisory applies to consumers and travel agents with bookings purchased from Sinorama Holiday Inc. located in Toronto ONLY.  Please note that the following information does NOT apply to consumers or travel agents that made their booking directly with Vacances Sinorama located in Quebec or in Richmond, BC.

Tours to China, Thailand, Cambodia, Japan, India and Vietnam
 

Consumers who have booked on these international tours with departure dates from August 21st onwards:

Please be advised that the air and land arrangements in destination (accommodation, bus tour, speed train, cruise and air travel in destination and any optional tours purchased) will NOT be provided.

Please be advised that consumers who are in possession of their International airline tickets (from North America to overseas) may have confirmed round trip air transportation.  Consumers who are in possession of their airline tickets are asked to contact the airline(s) or check the airline’s website to confirm their travel arrangements. 


I booked and paid Sinorama Holidays Inc. for a international tour with a departure date from August 21 and onwards, what are my options?


Option 1:

If you are in possession of your airline tickets and have confirmed your air transportation, you have the option to use the air transportation and make new replacement land arrangements at your own expense.  Consumers may file a claim for the original land arrangements paid for and not provided due to the failure of Sinorama Holidays Inc (accommodation, bus tour, speed train, cruise and air travel in destination and any optional tours purchased) from the Travel Industry Compensation Fund.

 

Option 2:

If your international airline tickets are not confirmed or you do not wish to travel, you may file a claim against the Travel Industry Compensation Fund for the travel services paid for and not provided due to the closure of Sinorama Holidays Inc.   


Note: Consumers who did not purchase their international air tickets from Sinorama and who purchased them directly from the airline or by some other means separately are subject to the terms and conditions of those services.  As those services were not purchased from Sinorama and are available to be received, they are not eligible for reimbursement from the Compensation Fund.



 Consumer Passports and Chinese Visas
 

Consumers who have provided Sinorama Holidays with their passports to obtain a Chinese Visa to travel will have their passports returned by Sinorama Holidays by Canada Post – Xpress Post with a signature required.  Alternatively, consumers may send an email to This email address is being protected from spambots. You need JavaScript enabled to view it. to make arrangements to pick up their passports in person at the travel agency's location in Markham, ON.

 

Ontario Travel Industry Compensation Fund

 

Consumers who purchased their travel services directly from Sinorama Holidays Inc. in Ontario and/or its website or through a registered Ontario travel agency

Consumers may file a claim form against the Travel Compensation Fund, see information below regarding claim forms.

Consumers who purchased travel services from an out-of-province travel agency (e.g. a travel agency located in Quebec, B.C. or the USA, etc.) who in turn booked with Sinorama Holidays Inc:

There is no provision under Ontario Regulation 26/05 pursuant to the Travel Industry Act, 2002 for a consumer to claim on the Compensation Fund when they have purchased travel services from an out-of-province travel agency.   TICO can only recommend that you contact your travel agency for further assistance.   

 

Claim Form

Consumers who will not be receiving all or a portion of their future travel services:

Consumers affected by the closure and who will not be receiving all or a portion of their future travel services may file a claim against the Travel Compensation Fund.

 

Consumers who commenced their travel services prior to August 08, 2018:

It is TICO’s understanding that there are no consumers currently in transit at risk of not receiving their travel services. However, there are consumer protection provisions in the event a consumer must pay in destination to complete their travel.

In the event that consumers incur expenses in destination (transportation, accommodation and meals) to complete their travel plans due to travel services not provided as the result of the closure of Sinorama Holidays Inc., consumers may have an eligible Trip Completion Claim against the Travel Compensation Fund.

Please note that there is a legislated 6 month filing deadline for claims. The deadline to file a claim in relation to the non-provision of future travel is February 11, 2019Please note that claims received at TICO beyond the filing deadline date will not be valid. Therefore, it is important to submit your claim prior to the filing deadline.

Filing a claim against the Ontario Travel Industry Compensation Fund:

Please be advised that the legislation requires claimants to exhaust all other possible remedies for reimbursement as part of the claims process.   Therefore, claimants who paid by credit card for the travel services not provided are required to contact their credit card company and dispute the charge and request a refund (credit / reversal of the charge on their account).  If, for some reason, your credit card company refuses to provide you with a credit refund, you will be required to obtain a letter from the credit card company stating that a credit refund will not be provided.  The letter from the credit card company will be required to be submitted with your claim against the Compensation Fund.

Should you not be able to obtain a chargeback (refund) from your credit card company or obtain all the documentation required in order to substantiate your claim in a timely manner, please submit your claim to ensure your claim is received at TICO prior to the deadline date. Any additional documentation that is required to complete the claim can be sent to TICO when it is obtained.

What other provinces in Canada have similar Compensation Funds?

Both Quebec and British Columbia have their own Travel Compensation Funds. The criteria to claim will vary based on the legislation in those provinces.
