On November 22, 2011, TICO’s Board of Directors approved payment of $78,540.00 to assist 62 consumers who did not receive the travel services for which they had paid. These payments were due to the closure of Affordablecruisesandtours.com Ltd. o/a Affordablecruisesandtours.com in Hamilton ($7,584.00); 1821284 Ontario Inc. o/a Atlas Air Travel in Toronto ($51,920.00); Panorama Travel & Tours Ltd. o/a flycentraleurope.com in St. Catharines ($11,685.53); Uniglobe Discover Travel in Kitchener ($1,800.00) and Carlos Ventura o/a Ventura Vacations in Pickering ($5,550.47).

The Board also denied eight claims. Six claims were denied based on section 57(1) of Ontario Regulation 26/05, which states that the customer must have paid for the travel services to or through a registered Ontario travel agency. These claims were filed by consumers who had purchased their travel services from travel agencies located in the U.S. Two claims were denied as they did not meet the requirements of section 58 of the Regulation.

The Ontario Travel Industry Compensation Fund is wholly-financed by the industry to protect consumers who do not receive the travel services for which they paid, due to the insolvency or bankruptcy of an Ontario-registered travel agent or travel wholesaler or due to the cessation of an end supplier airline or cruise line. The Fund only covers consumers who have booked through an Ontario-registered travel agent. The Fund is administered by the Travel Industry Council of Ontario, a not-for-profit corporation.
